Terms and Conditions

Important: By downloading, installing, or using any Sangar Studio application, you agree to these Terms in full. If you do not agree, do not use our apps.

1. Acceptance of Terms

These Terms and Conditions ('Terms') constitute a legally binding agreement between you ('User', 'you') and Sangar Studio ('we', 'us', 'our'), a sole proprietorship operated by its owner, governing your access to and use of all Sangar Studio mobile applications including EPPP Gamified, FriendlyAPK, Social Debt Tracker, Story Keeper, Startup Bucket List, Video to Wallpaper, and any future applications (collectively 'the Apps').

By using any of our Apps you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Apps on behalf of an organization, you represent that you have authority to bind that organization.

2. No Professional Advice - IMPORTANT

THE APPS DO NOT PROVIDE PROFESSIONAL, MEDICAL, LEGAL, PSYCHOLOGICAL, OR FINANCIAL ADVICE OF ANY KIND.

The content within our Apps, including but not limited to exam preparation questions, answers, explanations, and study materials, is provided for educational and informational purposes only.

Exam Preparation Apps (EPPP Gamified, NCLEX, MCCQE, and similar)

  • Content is generated with the assistance of AI tools and reviewed on a best-efforts basis. We do not guarantee the accuracy, completeness, or currency of any question or answer.
  • Use of our Apps does not guarantee passing any licensing examination.
  • We are not affiliated with, endorsed by, or connected to any licensing body, examination authority, regulatory board, or professional association.
  • Exam content, formats, and requirements change. We make no guarantee that our content reflects the most current exam specifications.
  • You are solely responsible for verifying information with official examination bodies before your exam.
  • Failure of any examination after using our Apps does not entitle you to a refund or any compensation.

Social Debt Tracker, Story Keeper, and Personal Apps

  • These apps are organizational tools only. We make no claims about their effect on your relationships, personal life, mental health, or social outcomes.
  • Information you enter is your own responsibility. We are not responsible for consequences arising from how you use or act on information tracked in these apps.

3. Disclaimer of Warranties

THE APPS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Sangar Studio expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the Apps will be uninterrupted, error-free, or free of viruses or harmful components
  • That the content in the Apps is accurate, complete, reliable, current, or suitable for any purpose
  • That defects in the Apps will be corrected
  • That the Apps will meet your requirements or expectations
  • That any exam preparation content will reflect current exam standards

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the maximum extent permitted by law.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SANGAR STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes, without limitation, damages for:

  • Loss of profits, revenue, data, goodwill, or other intangible losses
  • Failure to pass any professional licensing examination
  • Cost of substitute goods or services
  • Personal injury or property damage of any nature
  • Unauthorized access to or use of our servers and any personal information stored therein
  • Interruption or cessation of transmission to or from our Apps
  • Any bugs, viruses, or similar harmful code transmitted through our Apps
  • Any errors or omissions in any content, or any loss or damage incurred as a result of your use of any content
  • Loss of employment, income, or professional opportunity

In no event shall Sangar Studio's total liability to you for all claims arising from or relating to these Terms or your use of the Apps exceed the greater of: (a) the amount you paid to Sangar Studio in the 12 months prior to the claim, or (b) CAD $50.00.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, liability is limited to the minimum extent permitted by law.

5. Indemnification

You agree to defend, indemnify, and hold harmless Sangar Studio, its owner, officers, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Apps
  • Your violation of any term of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any claim that your use of the Apps caused damage to a third party
  • Any content you submit, post, or transmit through the Apps

6. Subscriptions, Payments, and Refunds

Payment

Certain Apps or features require payment. All payments are processed through Google Play or the Apple App Store. We do not directly handle or store payment card information.

Subscriptions

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions through your Google Play or Apple App Store account settings

Refunds

  • Refund requests are subject to Google Play and Apple App Store refund policies
  • We do not offer refunds based on exam results, content dissatisfaction, or failure to use the app
  • If you believe you were charged in error, contact us at heominaga@gmail.com within 14 days

EXAM FAILURE DOES NOT ENTITLE YOU TO A REFUND UNDER ANY CIRCUMSTANCES.

7. Intellectual Property

All content, features, and functionality of the Apps - including but not limited to text, graphics, logos, icons, images, audio clips, question content, gamification design, and software - are the exclusive property of Sangar Studio and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for your personal, non-commercial use only. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Apps
  • Reverse engineer or attempt to extract the source code
  • Scrape, harvest, or extract question content for any purpose
  • Reproduce exam questions or content outside of the App
  • Use the Apps to build a competing product

8. Acceptable Use

You agree not to use the Apps to:

  • Violate any applicable law or regulation
  • Impersonate any person or entity
  • Upload or transmit malicious code or harmful content
  • Interfere with or disrupt the integrity or performance of the Apps
  • Attempt to gain unauthorized access to any part of the Apps or related systems
  • Use automated tools to access, scrape, or interact with the Apps
  • Share your account credentials with others

We reserve the right to terminate your access immediately and without notice for any violation of these terms.

9. Third-Party Services

Our Apps may integrate with or link to third-party services including Google Firebase, Google AdMob, Google Play, and the Apple App Store. These services are governed by their own terms and privacy policies. Sangar Studio is not responsible for the practices, content, or availability of any third-party services.

10. Advertising

Some Apps display third-party advertisements to support free access. By using ad-supported apps, you consent to the display of advertisements. We are not responsible for the content of third-party advertisements.

In EPPP Gamified and similar apps, ads appear on result screens. Users achieving 100% quiz accuracy will not be shown ads on that result screen. This is a feature we offer at our discretion and may be changed or removed at any time.

11. Service Availability and Modifications

Sangar Studio reserves the right at any time and without notice to:

  • Modify, suspend, or discontinue any App or feature
  • Update, change, or remove content including exam questions
  • Change pricing for subscriptions or in-app purchases with reasonable notice
  • Impose limits on certain features or restrict access

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Apps.

12. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Apps ceases immediately.

You may stop using the Apps at any time. Termination does not entitle you to a refund of any paid subscription fees unless required by applicable law.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Canada, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Apps shall first be attempted to be resolved through good-faith negotiation by contacting heominaga@gmail.com. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Edmonton, Canada under the rules of the ADR Institute of Canada.

You waive any right to participate in class action lawsuits or class-wide arbitration against Sangar Studio.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION PROCEEDINGS AGAINST SANGAR STUDIO.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sangar Studio regarding your use of the Apps and supersede all prior agreements, understandings, or representations.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via in-app notification or email. Continued use of the Apps after changes are posted constitutes acceptance of the new Terms.

It is your responsibility to review these Terms periodically. The 'Effective Date' at the top indicates when the Terms were last updated.
